The discussion reveals fundamental disagreements over terminology and approach, with experts defining OCC broadly to encompass everything from vulnerability research and exploits to training and operational infrastructure. The commercial availability of these capabilities has lowered barriers to entry, enabling what one expert calls a "pay-to-play" model where governments can purchase offensive cyber programs rather than developing them in-house.

The panel highlighted significant challenges in regulating OCC compared to traditional arms proliferation. Unlike nuclear or chemical weapons, offensive cyber capabilities are built on pervasive vulnerabilities in everyday technology and rely on knowledge that overlaps substantially with legitimate cybersecurity research. Several experts warned against over-regulation, arguing that excessive controls would drive talent and capabilities to authoritarian regimes with fewer restrictions. One expert characterized Israeli companies like NSO Group as providing lawful interception tools rather than true OCC, suggesting regulatory confusion about what actually constitutes offensive capabilities.

The discussion reflected tensions between different regulatory approaches, with some experts advocating for stronger controls through export restrictions, law enforcement, and diplomatic pressure, while others argued that Western democracies should instead cultivate domestic OCC talent through fair engagement and appropriate procurement. The November 2021 US Commerce Department Entity List additions and April 2022 EU inquiry into NSO Group exemplify current regulatory efforts, though experts remain divided on their effectiveness and potential unintended consequences for Western cyber capabilities.
